米国における電磁界による訴訟を整理し，以下のような点をとりまとめた。 (1)人体への被害を理由として損害賠償を求める訴訟については，現在の時点では被告が敗訴した事例はない。これは，損害賠償訴訟においては電磁界と健康被害との間の因果関係を原告側が証明できないためである。 (2)人体影響(ないしはその風評)から下落した土地価格の補償を求める訴訟については，送電線を新設する際の補償においてこれを考慮した事例がある。この場合，電磁界の存在と土地価格の下落との間に「あれなければこれなし」の因果関係が証明されれば，たとえ電磁界の人体に対する影響について科学的に証明されていなくても，補償が認められる場合が米国での多数説である。ただし，このような考え方は現在の所送電線の新設の場合には適用されているが，既存の送電線に対しては認められてない。

Resently, some people in Japan are anxious about the effects of Electromagnetic Field (EMF) on human health, although there is no scientific evidence which states explicitly about the relationship between EMF and human health risk.On the other hand, a lot of cases have been presented about EMF health effects in the United States.In this paper, we survey some property condemnation cases and personal injury cases involving power line EMF health concerns in the United States.The Results are:Case law involving power line EMF personal injury concerns are sparse.Scientific uncertainty and expanse are the main barriers to institute such suits.Furthermore, EMF health suits are frequently settled with stipulations that details of the settlements are kept secret.In eminent domain cases, most courts in U.S. adapt the rule that evidence of lost market valus due to the fear of adverse health efforts may be introduced regardless of the reasonabless of the fear.There are three basic legal theories underlying property condemnation cases about EMF from existing power facility: trespass; nuisance; and inverse condemnation. Nevertheless, there have been no recoveries on any of these three theories.
