核燃料サイクルを構成する各事業毎に安全確保及び核物質管理に関する規制を行う我が国の原子炉等規制法は、原子力施設や核物質に着目した規制を敷く諸外国の原子力規制体系とはその規制構造が大きく異なっている。しかしながら、このような規制方法は、同一サイトで複数の事業を運営する際の重複する施設設置の要求や、事業等の目的を伴わない核燃料物質の単純所持に対する規制の不備に繋がる等、原子力を取り巻く新しい課題に十分に対応できなくなりつつある。そこで、本報告では、現行原子炉等規制法の抱える問題点を（1）規制の効率性及び（2）規制の実効性確保の視点から分析し、問題点を克服する複数の立法的解決試案の提案及びその比較検討を行った。本研究では、現行原子炉等規制法の使用許可制が物質規制としての機能が不十分である点は、テロ対策や有事対応といった視点から核物質防護や核物質規制の実効性確保の必要性が高まっている現状においては、喫緊に解決すべき課題であり、立法的解決の優先順位としては、一連の有事法制整備と並行する形で、先ずは現行規制の下で物質規制の実効性を確保するための規制強化を図り、その後、原子力事業の健全は発展の視点から原子炉等規制法の抜本的な改正に向けた取組みを行うべきであるとの結論を得た。

概要 （英文）

The Law for the Regulation of Nuclear Source Material, Nuclear Fuel Material and Reactors （The Nuclear Energy Regulation Law） has provided the legislative and regulatory framework governing the safety of nuclear installations and the nuclear safeguard for half a century, without being revised its basic regulatory structure. It has become increasingly difficult however, for the Nuclear Energy Regulation Law to respond effectively to establishment of new nuclear undertakers and to regulate nuclear fuel materials which those who are not assumed to be regulated by the current law possess. Addition, it is also expected that the current regulatory structure of the Nuclear Energy Regulation Law becomes a serious barrier for the existing unclear undertakers to carry out their businesses efficient. This paper firstly analyase those shortfalls in the Nuclear Regulation Law from the viewpoints of （1） efficient implementation of regulation and （2） effectiveness of regulation, and extends to practical strategies for legislation reforms to resolve those issues.
