大気中への二酸化炭素の排出を大幅に削減するための重要な技術的オプションとして二酸化炭素回収貯留（CCS）がある。CCSの広範な普及のためには、解決すべき多くの課題がある。貯留CO2の長期的な責任の取り扱いは、法規的な課題の中でも特に重要と考えられている。一般的に、長期的な責任が政府などの主務当局に移管する場合には、事業者に対して幾つかの条件が要求される。それらは、貯留CO2の漏洩等の重大なリスクがないことの証明、圧入停止からある一定期間の経過、財政保証あるいは財政負担への対応、である。これらの要求事項の規定や責任の移管の手続きについては各国で異なる。この報告書では、欧州、オーストラリア、および北米における長期的責任の取り扱いを明らかにする。EU加盟各国では、欧州CCS指令に沿って法規制整備が実施されている。豪州では、欧州CCS指令と類似した枠組みの法規制が存在する。米国およびカナダについては、連邦レベルでの長期的な責任に関する法規制は存在しないが、複数の州では存在している。

概要 （英文）

To achieve huge reduction of CO2 emissions to the atmosphere, it is expected that the Carbon Capture and Storage (CCS) might act significant roles. Rapid expansion of CCS raises many regulatory issues. Long-term liability for stored CO2 is one of the most challenging and complex aspects of regulating CO2 storage activities.
Generally, before liability is transferred to the competent authority, three requirements are imposed to the operator. Those are evidence that there is no significant risk ofphysical leakage or stored CO2, a minimum time period having elapsed from cessation of injection, and to prepare the financial security or contribution. There are marked differences between jurisdiction on how these requirements are interpreted in legislation and the way that liability is transferred.
In this report, long-term liability arrangements in Europe, Australia and North America are shown. Long-term liability arrangements in EU member states are set by the EU CCS Directive. In Australia, Commonwealth and state legislation generally follows principles similar to the EU CCS Directive. In the US and Canada, no federal long-term liability legislation has been enacted while some states have enacted legislation covering long-term liability for stored CO2.
